1. Parties and Scope

These Terms of Use (“Agreement”) govern the legal relationship between the CyberExamplatform (“Platform”), operated by CyberPath Bilisim Yazilim Uretimi Egitim Danismanlik Ticaret A.S. (“Company”, “we”), and any natural or legal person who accesses and/or uses this Platform (“User”, “you”).

By registering, accessing, or using any of our services, you acknowledge that you have read, understood, and accepted this Agreement in its entirety.

2. Service Description

CyberExam is an online education and examination platform that offers hands-on, lab-based certification exams in the field of cybersecurity. Through the Platform you can:

• Take cybersecurity certification exams,
• Measure your skills in hands-on lab environments,
• Earn certificates upon successful completion,
• Access blog and educational content,
• Benefit from career path recommendations.

3. Membership and Account Security

• A valid email address and a secure password are required to register on the Platform.
• You are responsible for all activity associated with your account. Do not share your password with third parties.
• If you notice any unauthorized access to your account, please immediately notify us at support@cyberexam.io.
• Creating accounts with false, misleading, or another person's information is prohibited.
• The Company reserves the right to suspend or terminate accounts that violate this Agreement without prior notice.

4. Exam Rules and Code of Conduct

• Exams must be completed individually. Receiving help from third parties, cheating, or using automated tools during an exam is strictly prohibited.
• Sharing, copying, or distributing exam questions, content, or answers in any medium is prohibited.
• If cheating or misconduct is detected, the exam result will be invalidated, the account may be closed, and no refund will be issued.
• Only the targets assigned within the exam scope should be worked on in the lab environments. Attempting to access systems outside the lab is prohibited.

5. Payment and Pricing

• Exam fees are displayed on the relevant certificate page on the Platform. Prices may be shown in Turkish Lira (TRY) or US Dollars (USD).
• Payments are processed through the secure payment infrastructure on the Platform.
• For refund conditions after a purchase is completed, please review our Refund Policy.
• The Company reserves the right to change prices. Changes do not affect exams that have already been purchased.

6. Intellectual Property Rights

All content on the Platform (exam questions, lab environments, educational materials, blog posts, designs, logos, software code) is the intellectual property of CyberPath Bilisim Yazilim A.S. or its licensors.

• Copying, reproducing, distributing, selling, or creating derivative works from the content is prohibited.
• Certificates earned are for personal use and may not be resold for commercial purposes.

7. Limitation of Liability

• The Platform is provided “as is.” The Company does not guarantee that the Platform will operate without interruption or error.
• The Company shall not be held liable for access interruptions caused by technical failures, maintenance, or force majeure.
• If you experience a technical issue during an exam, you must contact our support team. Valid technical issues will be evaluated, and exam access may be reassigned.
• The Company's total liability shall not exceed the amount paid by the User through the Platform in the last 12 months.

8. Protection of Personal Data

For detailed information on the processing of your personal data, please review our Privacy Policy. The Platform operates in compliance with applicable data protection regulations, including the Turkish Personal Data Protection Law No. 6698 (KVKK) and related legislation.

9. Changes to the Agreement

The Company reserves the right to update this Agreement at any time. Significant changes will be communicated through the Platform or via email. Your continued use of the Platform after an update constitutes acceptance of the changes.

10. Termination

• Users may request to close their account at any time.
• The Company may terminate an account without prior notice in the event of a breach of this Agreement.
• No refund will be issued for unused exam rights upon termination.

11. Governing Law and Dispute Resolution

This Agreement is governed by the laws of the Republic of Turkey. Istanbul Courts and Enforcement Offices shall have jurisdiction over any disputes arising from this Agreement.
